I'm helping my parents with Community Property Earnings

If you send money to your dad and mom to help them maintain expenses and you are transferring money from your account into their account. You should not be concerned about your spouse claiming an interest in their home or your spouse claiming a right to reimbursement.  Family Code section 4400 states that it is an adult child's duty to support an aging parent, specifically that an adult child "shall, to the extent of the adult child's ability, support a parent who is in need and unable to self-maintain by work." Case law has subsequently determined that the obligation to support an aging parent during the marriage (before separation) is considered a community debt and does not give rise to a right to reimbursement.
